Terms and Conditions for Signature Album Orders

Ordering via the Chantilly Lace LLC website Album Order form binds the buyer (hereafter referred to as "Client") to the following terms and conditions:

This agreement is between Chantilly Lace LLC (“Designer”) the “Client”.

Chantilly Lace LLC will perform album production services using pre-selected images for Client from a live Chantilly Lace gallery.

[Client] hereby grants Chantilly Lace LLC license to alter and manipulate the images under this agreement.

Chantilly Lace LLC and [Client] will work together to communicate the desired outcome of the final album proof.

 

Payment Terms

Payment is due and collected upon receipt of the order via credit/debit/check card on Chantilly Lace Llc's online order form. Production will not begin until payment is made in full.

 

All payments made are non-refundable.

 

All sales are final. Upon agreement of these terms and conditions, Chantilly Lace will not accept a cancellation of this order. [Client] understands that it is his or her responsibility to check the order for accuracy.​

Album upgrades are permitable while the album is still in production. Downgrading of albums is not permitted. Album upgrades must be made before first draft is complete.

​

Please note there is a $100.00 fee for returned items.

Final Total and Sales Tax All packages are subject to a sales tax, when applicable.

 

Design and Proofing Terms

The definition of a "page" is one side of a spread in an album (for example, a 20-page album contains 10 spreads).

The album revision process includes one complimentary round of unlimited changes. After the first round of revisions, if you wish to make more changes, there will be a $50 fee per change.

[Clients] shall review their album proofs via an online gallery. Instructions regarding album approval will be listed on the online album invite. [Clients] acknowledge that they understand how to view the album proof images from the web onto their computer. Chantilly Lace LLC is not responsible for user error in viewing and approving album proof images.

​

[Clients] have 1 week total to make revisions and approve the design, after which, no alterations will be made; the current draft will be finalized and sent to production. If an extension is needed, it is the client's responsibility to notify Chantilly Lace LLC in writing.

​

[Clients] online gallery will expire within 7 days after the date of delivery, then the revision time has ended. If the [Clients] should require their album proofs to be reuploaded a $50 retrieval fee will apply.

​

Chantilly Lace LLC will not place an album order with the manufacturer until [Clients] approve the album proofs in writing and the balance is paid on any upgrades or additional pages.

​

Additional pages requested after the initial order are $7.99 per page. Orders for additional pages will be billed immediately. Processing of the requested change will not occur until payment is made in full.

[Clients] agree that it is their responsibility to check their album proof for accuracy. Once final approval is given Chantilly Lace LLC is not responsible for typos, image defects, duplicate images, or other errors or changes that may have been missed.

​

We will retouch the images in the album at our discretion, but if you have specific retouching requests please let us know that during the album design process.

Companion albums are duplicate albums and cannot be altered from the original designs.

Delivery Terms

Expected turnaround time for [Clients] requests:

We estimate completing your Album Proof within [7-14 ] business days after receiving your image selections, based on the number of albums ordered and several design contingencies and our present production queue.

 

[Client] understands that changes to the order shall alter the expected turnaround time. Chantilly Lace LLC will provide an updated turnaround if this should occur.

​

Upon approval of the album, production at the lab for printing will take [3-5] business days.

​

Shipping is expected to take [5-7] business days.

​

Liability

While every possible precaution is taken and only reputable labs are used, Chantilly Lace LLC assumes no liability for the loss or damage of albums held in possession of the USPS, UPS, FedEx, etc. or after the album has been delivered or while at labs or outside sources for services.

Misc. Terms

[Client] agrees to indemnify and hold Chantilly Lace LLC harmless against any and all claims, costs, and expenses, including attorney’s fees, due to materials in the design at the request of [Client] to which [Client] does not possess copyright permission or usage rights.

​

Chantilly Lace LLC maintains free creative license with respect to the artistry, style, and composition of design. Client understands that he/she has viewed samples of previous work in sample albums, proof albums, or online slideshows and is satisfied with the overall style of design that is presented, but understands that creative license and differences in photographs, location, and storytelling allow for variations in composition and layout of the presented final design.

Accepting these terms and conditions shall be the sole agreement between Chantilly Lace LLC and the [Client]. No other agreements, verbal or written, shall be considered binding or valid upon signature of this design contract by both parties.

​

This terms shall not be modified or otherwise altered unless approved in writing by both Chantilly Lace LLC and [Client].

 

This design contract shall be governed by the laws of South Carolina. Any legal disputes or proceedings shall take place in South Carolina.
